根据裁判Chip Clark引用的《裁判执裁手册》，如果进攻方和防守方同时确定了自己的位置，在这种情况下发生的犯规，必须是防守犯规（Even if they get to the spot at the same time, a tie will result in a defensive foul.）。
简单来讲——防守人必须提前占据位置，才有可能造成进攻犯规；如果防守人比进攻人迟到或者同时到，那就是防守犯规。
因此，昨天这个球，因为内史密斯没有提前建立位置，所以是他犯规。
